Work & Residency Pathways for Taiwan Residents

Relocating to the USA

Information based on current research for Taiwan residents wishing to live and work in the United States.

Available Visa Types for Taiwan Residents

Taiwan residents primarily utilize the H-1B Specialty Occupation Visa, the L-1 Intra-company Transferee Visa, or the J-1 Exchange Visitor Visa. Taiwan's inclusion in the Visa Waiver Program (ESTA) allows for business visits, but all employment requires a formal visa petition sponsored by a US employer.

Main Work Routes

H-1B Visa

For professionals with a bachelor's degree or higher. Subject to an annual lottery. Heavily used by Taiwan's tech talent in Silicon Valley.

L-1 (Transfer)

For transfers within multinational companies (e.g., TSMC, Foxconn). Valid for up to 7 years. Spouses can obtain work authorization.

J-1 Visa

For interns and trainees to gain experience in US companies. Common for recent graduates from Taiwan's top universities.

General Requirements

Valid Taiwan Passport (with ID number)
Approved Nonimmigrant Petition (I-797 Approval Notice)
Degree certificate and transcripts in English
Submission of DS-160 and MRV visa fee
Proof of ties to Taiwan (for J-1 and certain statuses)

Typical Process

1
USCIS Petition filing

The US employer files the I-129 petition with USCIS. Once approved, the employee gets an I-797 notice.

2
AIT Visa Application

Complete the DS-160. Create an account on the AIT visa portal to book an interview in Taipei.

3
Attend Interview

Visit the American Institute in Taiwan (Neihu office). Bring the I-797 and academic records.

4
Visa Collection & Entry

After approval, the visa is placed in your passport and returned via courier. You can enter the US up to 10 days before your job starts.
